illegible, forged, destroyed, incomplete, mechanically duplicated, mass machine printed,
postage due or entries not otherwise in compliance with the Official Rules (and such
entries will be disqualified). |
| 5. If for any reason a ShortTrackin.com event is not capable of
running as planned, including infection by computer virus, bugs, tampering, unauthorized
intervention, fraud, technical failures or any other causes beyond the control of
ShortTrackin.com which corrupt or affect the administration, security, fairness, integrity
or proper conduct of the event, ShortTrackin.com reserves the right at its sole discretion
to disqualify any individual who tampers with the entry process, and to cancel, terminate,
modify or suspend the event. ShortTrackin.com assumes no responsibility for any error,
omission, interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorized access to, or alteration
of, entries. ShortTrackin.com is not responsible for any problems or technical malfunction
of any telephone network or lines, computer on-line systems, servers or providers,
computer equipment, software, failure of any e-mail or submission to be received by
ShortTrackin.com on account of technical problems or traffic congestion on the Internet or
at any web site, or any combination thereof, including any injury or damage to
participant's or any other person's computer related to or resulting from participation or
downloading any materials in this contest. CAUTION: ANY ATTEMPT BY ANY PERSON TO
DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE LEGITIMATE OPERATION OF THE GAME IS A
VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SHORTTRACKIN.COM
RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY
LAW. Should events be terminated prior to the stated event date, notice will be posted on

| 6. ShortTrackin.com is not responsible for technical, hardware or
software failures of any kind, lost or unavailable network connections or failed,
incomplete, garbled or delayed software transmissions which may limit an player's ability
to participate in an event or damage player's system as a result of participation in an
event or downloading any information necessary to participate in an event. |
| 7. No substitution or transfer of prizes permitted by winners. Taxes,
if any, are the responsibility of the winner. |
| 8. Winners, by acceptance of a prize, agree to release
ShortTrackin.com, its parent, subsidiary and affiliated businesses and each of their
officers, directors, shareholders, employees, advisors, assignees, agents, licensees,
representatives and any other person or entity associated with ShortTrackin.com from any
and all liability claims or actions of any kind whatsoever for injuries, damage or losses
to persons and property which may be sustained in connection with the receipt, enjoyment,
ownership or use of the prize. ShortTrackin.com expressly disclaims any responsibility or
liability for injury or loss to any person or property relating to the delivery and/or
subsequent use of any prize awarded. |
| 9. Each entrant agrees that: (1) any and all disputes, claims, and
causes of action arising out of or in connection with ShortTrackin.com, or any prizes
awarded, shall be resolved individually, without resort to any form of class action, and
any judicial proceeding shall take place in a federal or state court within the State of
North Carolina; (2) any and all claims, judgments, and awards shall be limited to actual
out-of-pocket costs incurred playing ShortTrackin.com, but in no event attorneys' fees;
and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant
hereby waives all rights to claim, punitive, incidental, and consequential damages, and
any other damages, other than for actual out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased. |

interpretation and enforceability of these Official Rules, or the rights and obligations
of entrant in connection with ShortTrackin.com, shall be governed by, and construed in
accordance with the laws of the State of North Carolina, without giving effect to any
choice of law or conflict of law rules or provisions (whether of the State of North
Carolina or any other jurisdiction), that would cause the application of the laws of any
jurisdiction other than the State of North Carolina. |
